Terms of Use.

These Terms of Use govern access to and use of this website, our contact and booking doors, the website chat, and the Symmetry client portal at platform.symmetryva.com (together, the "Services") provided by Symmetry VA ("Symmetry," "we," "us"). Please read them carefully.

1. Acceptance of terms

By using the Services, you agree to these Terms and to our Privacy Policy. If you accept on behalf of a company or practice, you represent that you are authorized to bind it. If a client has a signed engagement agreement with Symmetry, that agreement controls where it conflicts with these Terms.

2. Relationship to your engagement agreement

The scope of work, fees, billing, term, and governing law for services Symmetry performs for a client are set out in that client's engagement agreement, not here. Where a client is a HIPAA Covered Entity and Symmetry handles protected health information (PHI) for it, the Business Associate Agreement (BAA) between us governs that handling; see also our HIPAA & PHI Commitment.

3. The client portal

  • Portal access is granted per client, by invitation, to people the client designates. You use the portal on behalf of the client that invited you.
  • The client may ask us to revoke any user's access at any time, and access ends when the engagement ends.
  • You sign in with your own account and are responsible for keeping its credentials safe. Tell us promptly if you believe your access has been used without authorization.
  • We grant a limited, non-exclusive, non-transferable right to use the portal for the client's internal purposes during the engagement.

4. Acceptable use

  • No unlawful, infringing, or abusive use, and no attempts to breach security or access data you are not authorized to access
  • No scraping, automated access, or interference with the Services or the systems that run them
  • Use of PHI must comply with HIPAA, the client's policies, and the BAA
  • Do not submit information through the chat, contact, or booking doors that you do not have the right to share

5. Access to your systems

When a client gives Symmetry staff access to its own systems, tools, or accounts to do the work it has engaged us for, that access is governed by the engagement agreement and, for PHI, the BAA. We use it only for the engaged work and only as the client directs.

6. Data and content

The client retains ownership of its data and of the records in its own systems. On written request, we provide a client with a copy of its data in a commonly used format. Materials on this website, including text, graphics, logos, and software, are owned by or licensed to Symmetry and protected by copyright and trademark law. Content on this website is for general information and does not constitute medical, legal, financial, or other professional advice. We may use de-identified operational metrics, scoped to a single client, to operate and secure the Services. We do not pool client data across clients, and we do not use client data or PHI to train models.

7. Third-party services and links

The Services rely on third-party providers, such as identity and sign-in, scheduling, chat, and hosting, and this website may link to third-party sites. We are not responsible for the content or privacy practices of third parties.

8. Availability

We aim to keep the Services available but do not guarantee uninterrupted access. Maintenance, provider outages, and factors beyond our control may affect availability.

9. Disclaimers

The Services are provided "as is" and "as available," without warranties of any kind to the extent permitted by law. The Services support, but do not replace, the professional judgment of the client and its licensed staff.

10. Limitation of liability

To the maximum extent permitted by law, Symmetry is not liable for indirect, incidental, special, or consequential damages arising from use of or inability to use the Services, and our aggregate liability for services performed for a client is limited as set out in that client's engagement agreement.

11. Termination

We may suspend or end access to the Services for a breach of these Terms. A client's engagement ends as set out in its engagement agreement. On termination, portal access ceases and the client's data is handled per the engagement agreement, the BAA where one applies, and applicable law.

12. Changes

We may update these Terms and will post the revised version here with a new effective date. Continued use of the Services after changes constitutes acceptance.
